Judges drop case against congressional candidate

A panel of appellate court judges has dismissed the case of a prominent Orange County Republican lawyer who challenged Debbie Cook’s use of her title as Huntington Beach mayor on the ballot in her bid to unseat Rep. Dana Rohrabacher.

Attorney Mike Schroeder challenged Cook’s use of “Mayor, city of Huntington Beach” as her designation on the ballot, claiming it was not a title directly elected by voters, suing both her and the Orange County Registrar of Voters.

Court records show a petition by Cook’s attorney Mark Rosen to dismiss the case was granted. Rosen had argued that any such suit needed to name the Secretary of State as a defendant and had to be filed in Sacramento.

Cook said she was cautious about celebrating because she didn’t yet know details of the opinion, which was not available in full. She wasn’t sure whether it was possible for Schroeder to refile a case.

“We’re not popping any champagne corks just yet,” she said.

Efforts to reach Schroeder were unsuccessful.
